Principles of Processing Personal Data

Personal data processing controller is SIA “WINE COUNTRY”, registration No. 51203073921, address: Andrejostas iela 17a, LV-1045, Riga, (hereinafter — Wine Country). Principles of Processing Personal Data (hereinafter also — Principles) provide information on how Wine Country processes personal data of its Clients or other visitors (hereinafter also — you or your) of www.winecountry.lv in relation to the services offered or provided by Wine Country.  The Principles provide the purposes and legal bases of processing personal data, data protection measures and your rights in regard to data processing.

SIA “Wine Country” performs processing of personal data in line with the applicable laws and regulations: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and national laws and regulations in the area of data privacy.

  1. Definitions
    • Client — a natural person who uses, has used, or has indicated he/she would use the products and services of Wine Country.
    • Contract — contract concluded between Wine Country and the Client.
    • Personal data — any information that refers to an identified or identifiable natural person.
    • Processing — any activity or sets of activities performed with the personal data or sets of personal data that is/are carried out with or without automatic means, for example, collection, registration, organising, structuring, storage, adapting or modifying, restoring, viewing, use, disclosing by sending, distributing or otherwise making the data available, coordinating or combining, restricting, deletion or destroying.
  1. Obtaining personal data
    • Wine Country obtains your personal data as follows:
      • directly, when you provide your personal data by filling in the order form;
      • indirectly from public sources when, considering the nature of the offered product and service, it is necessary to identify the Client and confirm the age of the Client.
  1. Cookies
    • Cookies are used for a more convenient use of the site winecountry.lv. Cookie is a small text file that is saved on the computer or mobile device of the visitor of www.winecountry.lv. Cookie allows to remember the visitor’s activities and choices, for example, registration, language and other display preferences, so that information does not have to be provided every time when the visitor returns to the website. Cookies cannot identify you.
    • Cookies contain information that the network server sends to the network browser and that the browser saves. Cookies store such information as IP address, type of device used, browser used, activity in the website and visited websites.
    • Several types of cookies for different purposes are used at the website winecountry.lv:

    • Google Analytics developed by Google LLC uses cookies to obtain statistical data based on the visits of the website.
    • Facebook Pixel system developed by Facebook Inc. is used to summarise statistics on the visits of websites and interests and behaviour of visitors and to measure the efficiency of online marketing measures.

              Third parties do not store personally identifiable information, therefore the habits of website use are viewed only in a summarised and anonymous form.

  1. Consent to data processing for direct marketing
    • Wine Country can process personal data based on your consent to receive direct marketing messages.
    • With your consent, we will send you direct marketing messages to your e-mail/phone. You can withdraw your consent regarding the processing of your personal data, any time using the withdrawal link that is available in the marketing message sent to your e-mail/phone or contacting us via e-mail: info@winecountry.lv. If you refuse from direct marketing messages, Wine Country will restore your personal data processing settings to ensure that direct marketing messages are not be sent to you any more.
    • Withdrawal of consent will not impact the lawfulness of processing that was conducted before the withdrawal of consent.
  1. Disclosure of information and data processors
    • Personal data are processed in the European Union/European Economic Area (EU/EEA).
    • Wine Country does not disclose personal data to unrelated third parties, unless it is necessary to ensure compliance with the laws and regulations or the Contract, or based on your consent, or it is otherwise lawfully acceptable and/or requested.
    • When processing personal data, Wine Country uses only carefully selected service providers (hereinafter — Data Processors).
    • To fulfil the Contract, Wine Country uses the following categories of Data Processors: legal and other advisers, courier service providers, data storage service providers, e-mail and SMS gateway service providers, identification and certification service providers, payment service providers.
    • Personal data can be transferred to persons provided in the laws and regulations upon their reasonable request in line with the procedure and scope stipulated in the laws and regulations, and personal data may have to be transferred in cases prescribed in the laws and regulations to protect the legal interests of Wine Country, for example, when filing a request to the court or other state authorities against a person who has harmed the legal interests of Wine Country.
  1. Protection measures
    • Wine Country protects your personal data by using technical and organisational means, including the following protection measures:
      • clean desk and screen policy;
      • locked premises and limited access to unauthorised persons;
      • use of firewall software;
      • encryption of data.
  1. Storage of data
    • Wine Country stores your personal data only as long as it is necessary to achieve the purposes of processing, to protect its rights, or in line with the storage term stipulated in the laws and regulations.
  1. Your rights in regard to the data processing
    • You have the following rights:
      • access rights;
      • rights to withdraw your consent;
      • rights to modify your data;
      • rights to restrict processing of personal data;
      • rights to data portability;
      • rights to be forgotten;
      • rights to object against processing of personal data;
      • rights to turn to the authority supervising data processing (State Data Inspectorate, dvi.gov.lv, Blaumaņa iela 11/13-15, Riga, LV-1011, tel.: +371 67223131, e-mail: info@dvi.gov.lv) in regard to matters related to processing of personal data or to submit a complaint. Before addressing the Inspectorate, please contact us (see Section 11 Contact Information) for help in case of doubt.
  1. Validity of the Principles and amendments thereto
    • If the personal data processing practice of Wine Country changes or if it is necessary to change these Principles in line with the applicable laws and regulations, case-law, or instructions of competent authorities, Wine Country is entitled to amend these Principles unilaterally by publishing the updated version at the website: winecountry.lv
    • Every next version of these Principles published at the website: winecountry.lv replaces all previous versions of the Principles and becomes effective as at the moment of publishing.
    • This version of the Principles is effective as of 3 March 2021.
